Human Rights Tribunal of Ontario
B E T W E E N:
Guy Babineau Applicant
-and-
Her Majesty the Queen in right of Ontario as represented by the Minister of Municipal Affairs and Housing and Elizabeth Beckett Respondents
Interim DECISION
Adjudicator: Kaye Joachim Date: November 6, 2009 Citation: 2009 HRTO 1899 Indexed as: Babineau v. Ontario (Municipal Affairs and Housing)
1This is an Application filed under section 53(3) of the Part IV of the Human Rights Code, R.S.O. 1990, c. H.19, as amended (the "Code") on December 30, 2008.
2The applicant has made a request that I recuse myself from further participation in this Application on the basis of various Interim Decisions I have written. The applicant does not allege that the decisions give rise to a reasonable apprehension of bias on my part. Rather, the argument is that my decisions to request submissions on whether to add the Landlord and Tenant Board as a party, to subsequently add the Board as a party, and to hear the respondents' request for early dismissal against the Minister of Municipal Affairs and Housing and Elizabeth Beckett have violated the applicant's rights.
3In my view, the above rulings do not give rise to any basis for me to recuse myself from further participation in these proceedings.
Dated at Toronto, this 6th day of November, 2009.
