1This is an Application filed under section 53(5) of the Part IV of the Human Rights Code, R.S.O. 1990, c. H. 19, as amended (the “Code”) perfected on March 23, 2009.

2The purpose of this Interim Decision is to deal with a Request for Order During Proceedings (Request) seeking the production at the hearing of an original of a document (the “birthday card’), a photocopy of part of which has already provided by the applicant, and her passport.

3The Request is granted as it relates to the entire, original of the birthday card. It is reasonable that if any part of a document is to be relied upon the entire of that document should be produced. The applicant will bring the original of the birthday card to the hearing.

4The Request as it relates to the applicant’s passport is not allowed. The respondent provided no reason why it is relevant to this Application. The stated reason relates to another proceeding related to issues arising long after the allegations in the complaint and therefore beyond the scope of the issues in dispute in the Application.
