1The applicant filed an Application under s. 34 of the Human Rights Code, R.S.O. 1990, c. H.19, as amended, (the “Code”) on March 27, 2009. The matter is scheduled to proceed to a hearing in February 2010.
Request to Withdraw
2On September 22, 2009, the applicant filed a Request to Withdraw the Application against the Canadian Auto Workers, Local 1973 (“Union”). Neither respondent has responded to the Request to Withdraw and the time for doing so under the Tribunal’s Rules of Procedure (“Rules”) has now elapsed.
3The Request to Withdraw is granted. The Application as against the Union is withdrawn with leave of the Tribunal and the style of cause is amended accordingly.
Request to Amend the Application
4On October 9, 2009, the applicant filed a Request for an Order During Proceedings (“Request”) asking to amend the Application. He wishes to remove contracts as the area of alleged discrimination and replace it with employment. Neither respondent has responded to the Request and the time for doing so under the Rules has elapsed.
5The Request is unopposed. The amendments are appropriate and the Request is granted.
