Human Rights Tribunal of Ontario
B E T W E E N:
Marisa Osman Applicant
-and-
Elle Productions Security Company and Lori McInskie Respondents
Decision
Adjudicator: Faisal Bhabha Date: November 3, 2009 Citation: 2009 HRTO 1853 Indexed as: Osman v. Elle Productions Security Company
1The applicant filed an Application under s. 34 of the Human Rights Code, R.S.O. 1990, c. H.19, as amended (the "Code"), on September 9, 2008. The Tribunal attempted unsuccessfully on several occasions to serve the Application on the respondents.
2In an Interim Decision dated September 8, 2009, 2009 HRTO 1426, I directed the applicant to provide further information with respect to contact information for the respondents. She was to have provided such information within 20 days. Now more than 50 days have passed and no further information has been received from the applicant. Part of the elapsed time was caused by a failed attempt to send the applicant the Tribunal's Interim Decision. However, even taking that into account, upon receiving the Interim Decision, the applicant still had ample opportunity to provide the information required, and has not.
3The Tribunal relies on applicants to provide a correct address for respondents named in their applications: Guild v. Kyle-Jansen, 2008 HRTO 347. Rule 6.6(b) provides that the Tribunal will not deal with an Application in respect of a respondent who cannot be contacted at the contact information provided by the applicant.
4The contact information provided by the applicant for the respondents is either incorrect or incomplete. The Tribunal has been unable to deliver the Application to the respondents at the address provided. The Tribunal has attempted to obtain corrected information from the applicant to no avail.
5In light of this, the Tribunal cannot continue to deal with the Application. Accordingly, the Application is dismissed.
Dated at Toronto, this 3rd day of November, 2009.
