1This Decision deals with an Application under section 34 of the Human Rights Code, R.S.O. 1990, c. H.19 as amended, (the "Code"). The Application was filed on behalf of the applicant by Eric del Junco, a lawyer. The Application was processed and a date for a mediation session was scheduled for May 2009. Mr. del Junco subsequently contacted the Tribunal to advise that the applicant was unable to attend the mediation for health reasons and asked that it be postponed until September 2009. The mediation was cancelled. The Tribunal then contacted Mr. del Junco and the applicant to set a new date for a mediation session but did not receive a response.
2On October 14, 2009, the Tribunal wrote to Mr. del Junco and the applicant to advise that the file would be closed within ten days if no response was received with respect to the attempts to reschedule the mediation. On October 28, 2009, Mr. del Junco contacted the Tribunal to advise that he has been unable to contact his client or seek instructions.
3In the circumstances, the Application is dismissed and the Tribunal will close its file regarding this Application.
