1This decision reconsiders the Tribunal’s Interim Decision dated October 2, 2009, 2009 HRTO 1599.
2In that Interim Decision I stated that the respondent had not filed a Response to the Application and ordered that the respondent to file a Response and its explanation for its failure to respond. Subsequently, it was discovered that the respondent had in fact filed a Response, albeit after the 35 day period for doing so, but through an administrative error the Response was not placed on the file.
3In the circumstances, while it appears the Response was filed late, I accept the Response and the respondent is not required to comply with my previous order.
4The Registrar will serve the Response and, as both parties indicate an interest in mediation, will schedule a mediation.
