1This is an Application filed under s. 34 of the Human Rights Code, R.S.O. 1990, c. H.19, as amended. On August 4, 2009, the Tribunal sent the applicant a Notice of Intent to Dismiss the Application on the basis that the Application appeared to be outside the Tribunal’s jurisdiction. The Notice, which was sent to the applicant at the contact information provided in the Application, directed the applicant to provide submissions by September 3, 2009 explaining why the applicant believes the Tribunal has jurisdiction to deal with the Application.

2On September 28, 2009, the Tribunal sent a letter to the applicant advising that the Tribunal had not received any submissions in response to the Notice of Intent to dismiss, and directing the applicant to make such submissions by October 8, 2009, failing which the Tribunal would consider whether the Application should be considered abandoned.

3The applicant did not respond to the Notice of Intent to Dismiss or the Tribunal’s letter of September 28, 2009 to explain why the applicant believes that the Application is within the Tribunal’s jurisdiction. In accordance with Rule 5.4 of the Tribunal’s Rules of Procedure, the Application is hereby dismissed as abandoned.
