1This is an Application filed September 23, 2008 under section 53(3) of Part VI of the Human Rights Code, R.S.O. 1990, c. H.19, as amended (the “Code”).

2On November 27, 2008 the corporate respondent advised the Tribunal that it could not accept service on behalf of the personal respondent Paul Boyd as he no longer works for the corporate respondent. In 2008 HRTO 330 the Tribunal directed that if the applicant wished to proceed with the Application against Mr. Boyd she should serve him with a copy of the Application within 10 days of that Interim Decision or advise the Tribunal if she did not want to proceed with Mr. Boyd as a respondent.

3On February 17, 2009 the applicant wrote to the Tribunal advising that she did not wish to proceed against Mr. Boyd.

4Accordingly the Application as against Mr. Boyd is withdrawn with leave of the Tribunal.
