1A Case Resolution Conference (“hearing”) in this matter is scheduled for November 16, 2009. The purpose of this Interim Decision is to address the respondent Bretscher’s request to request to give his evidence in the hearing by teleconference.

2Mr. Bretscher, a personal respondent who no longer works for the corporate respondent, resides in Saskatchewan. He is represented by counsel for the corporate respondent and it is not anticipated that his evidence will be pivotal to the issues in the Application.

3In the circumstances, I find that it would be fair just and expeditious to permit Mr. Bretscher to testify by telephone.
