1This Application was filed February 17, 2009 under section 53(5) of Part VI of the Human Rights Code, R.S.O. 1990, c. H.19, as amended (the “Code”). This Interim Decision deals with a Request for Order during Proceedings seeking to add and remove parties as respondents to this proceeding.

2The applicant consented to the removal of the personal respondent, Glen MacQuarrie and the style of cause has been amended accordingly. The applicant seeks to add Susan Thorne, the Human Resources Manager as a respondent.

3The institutional respondent has accepted that it is vicariously liable for the actions of Ms. Thorne. The allegations against Ms. Thorne are not likely to result in a personal order against her. In these circumstances, the request to add Ms. Thorne is denied.
