1This is an Application filed April 22, 2009 under section 53(5) of Part VI of the Human Rights Code, R.S.O. 1990, c. H.19, as amended (the “Code”).

2The purpose of this Interim Decision is to address a Request for Orders During Proceeding filed by the respondents seeking deferral, mediation and particulars.

3The Hearing in this matter is scheduled to proceed on December 9, 2009. The applicant has declined to participate in a further mediation, so it would not be appropriate to schedule mediation in this matter.

4The applicant denies that there is any outstanding proceeding to which the present Application should be deferred. The Tribunal is not satisfied there is another proceeding which would justify deferring the Application.

5The applicant has recently filed detailed statements of facts and documents, subsequent to the Request for Order, so the request for particulars is moot.
