INTERIM DECISION
Adjudicator: Kaye Joachim Date: October 14, 2009 Citation: 2009 HRTO 1673 Indexed as: Ellis v. Ontario Secondary School Teachers’ Federation
1These Applications were filed in June 2009 under section 53(5) of Part VI of the Ontario Human Rights Code, R.S.O. 1990, c. H.19, as amended (the “Code”). The Hearing is scheduled for April 2010. This Interim Decision deals with the applicant’s request that the respondent school board (the “School Board”) provide contact information for certain persons the applicant intends to call as witnesses. The respondents were given an opportunity to respond to this request but did not file a response.
2The applicant set out a list of 17 names and a brief description of why they were relevant, in a letter dated August 19, 2009. The persons appear to be primarily students, parents or teachers who have some knowledge of events the applicant believes relate to his Applications. The School Board appears to be in the best position to provide the information requested, if they have it.
3Accordingly, the School Board is directed to provide the last known contact information with respect to the persons identified in the applicant’s letter of August 19, 2009, to the Tribunal and the applicant and the other parties, or an explanation why the information is not produced. The School Board shall have 45 days to provide this information.
Dated at Toronto, this 14th day of October, 2009.
