1This Application was filed December 30, 2008 under section 53(3) of Part VI of the Human Rights Code, R.S.O. 1990, c. H.19, as amended (the “Code”). The Case Resolution Conference is scheduled for October 29 and 30, 2009.
2The purpose of this Interim Decision is to address the respondents’ Request for an Order during Proceedings seeking to combine the present Application with an Application filed by the personal respondent in 2009-03023-I against the applicant’s son. Application 2009-03023-I was filed by Mr. Nigro under section 34 of the Code and alleges that the applicant’s son has taken actions to reprise against him for exercising his rights under the Code.
3The section 34 Application has not yet been served upon the respondent.
4The respondents’ request to process the two Applications together is denied.
5Although there is some overlap between the parties, the respondent in 2009-03023-I is not involved in the present Application.
6The alleged reprisal action arising in 2009-03023-I is unrelated to the allegations in the present Application.
7Processing the Applications together would delay the processing of the current Application which is scheduled to proceed later this month.
