1The Tribunal issued an Interim Decision Guilmoutdinov v. Ontario College of Teachers, 2009 HRTO 1427) finding that the individual complainants were barred from proceeding with their Complaints by section 34(11) of the Code and that the Commission may continue with the Complaints as though they were an application made under section 35 of the Code.

2By email dated September 22, 2009, counsel for the Commission advised the Tribunal that all issues between the Commission and the respondent had been resolved and that accordingly, the scheduled hearing dates were not required.

3The Tribunal interprets the above-mentioned letter as a request to withdraw the Complaint. The Complaint is withdrawn with leave of the Tribunal.
