Reasons for Decision

1The applicant filed an Application under s. 34 of the Human Rights Code, R.S.O. 1990, c. H.19, as amended, (the "Code"), on February 24, 2009. The applicant and the respondent agreed to attend mediation, and a mediation session was scheduled for August 4, 2009. The respondents attended the session but the applicant did not. The Tribunal attempted to contact the applicant to consult about new dates but he did not respond.

2In a letter dated August 11, 2009, the Tribunal advised the applicant that if he did not respond within 10 days of the date of the letter, the Tribunal would deem the Application abandoned and close its file. The applicant has not responded to the Tribunal's correspondence.

3In the circumstances, the applicant is deemed to have abandoned the Application and the Application is dismissed on that basis.
