1This is an Application filed on December 24, 2008 under section 34 of Part IV of the Human Rights Code, R.S.O. 1990, c. H.19 as amended (the “Code”). In this matter, a hearing has been scheduled for Thursday, November 12, 2009, to deal with preliminary issues raised by the respondent the College of Physicians and Surgeons of Ontario (CPSO).
2The applicant has filed a Request for an Order During Proceedings requesting leave to amend the Application, and has filed an amended Application. The applicant states that the respondents have consented to the amendments and further, that the amendments clarify the applicant’s position and do not add additional issues to the Application.
3On the basis of the material before me, and the consent of the parties, the Tribunal grants leave to amend the Application. The Application filed on December 24, 2008 is replaced by the amended Application filed August 24, 2009.
4The respondents may file amended Responses by October 16, 2009. The applicant may file an amended Reply by October 30, 2009.
5I am not seized of this Application.
