1These are three Applications filed under section 53(5) of the Human Rights Code, R.S.O. 1990, c. H.19, as amended (the “Code”). This Interim Decision deals with a respondent’s objections to the Applications being processed together. The Applications are described in my earlier Interim Decision 2009 HRTO 1472 (the “Interim Decision”).
2In accordance with its usual practice the Tribunal notified the parties on September 1, 2009 of its intention to process these three Applications together because they appeared to raise similar factual and legal issues. The parties were advised that, if they had any objection to this procedure, to provide their submissions within ten days. Submissions were received on September 9, 2009 from the applicant. In the Interim Decision, the Tribunal considered the submissions of the applicant and determined that the most fair, just and expeditious manner of determining these Applications was to process them together.
3After the Interim Decision was released, I was provided with submissions from the respondents in file TR-0965-09 objecting to the Tribunal’s proposal. The submissions are dated September 9, 2009 but were not received by the Tribunal until September 11, 2009.
4Despite the fact that these submissions were late, I have reviewed and considered them. I am satisfied they would not have changed the result of the Interim Decision had they been provided in a timely manner.
5I am not seized of these matters.
