HUMAN RIGHTS TRIBUNAL OF ONTARIO
B E T W E E N:
Adrienne Jarabek Applicant
-and-
OC Transpo and the City of Ottawa Respondents
DECISION
Adjudicator: David A. Wright Date: September 14, 2009 Citation: 2009 HRTO 1466 Indexed as: Jarabek v. OC Transpo
1In a previous Interim Decision, 2009 HRTO 1094, the Tribunal invited submissions from the applicant about whether the Tribunal had jurisdiction over this Application in light of the fact that OC Transpo has been found to be a federally-regulated business to which the Canadian Human Rights Act, R.S.C. 1985, c. H-6, and not the Ontario Human Rights Code, R.S.O. 1990, c. H.19, as amended, applies; see Morgan v. Ottawa (City), 2008 HRTO 145. The applicant did not make any submissions by the date set.
2As the Tribunal has found that OC Transpo is a federally-regulated business to which federal human rights legislation applies, and the applicant has made no argument as to why the allegations made fall under provincial jurisdiction, I find that the Tribunal has no jurisdiction over the subject-matter of this Application.
3The Application is dismissed.
Dated at Toronto, this 14th day of September, 2009.
