1This matter is proceeding to a Hearing on October 9, 2009 to hear the respondents’ preliminary request for dismissal on the basis that the matter has been settled. The applicant has filed a request for reconsideration of a Case Direction Assessment I made directing the respondent witness to testify by telephone.

DECISION

2The Request for Reconsideration is dismissed.

3Rule 25.1 provides that a party may request reconsideration of a final decision. The decision directing the manner in which the witness may testify is not a final decision. However, the applicant may raise the issue whether the telephone participation contravenes the witness’s obligation not to indirectly communicate with the applicant with the Member at the hearing.
