1In its Interim Decision Hunter v. Vermeer 2009 HRTO 104 which dealt with the respondent’s request for deferral of this Application, the Tribunal noted that no submissions had been received from the respondent, as had been previously directed by the Tribunal.

2In fact, the respondent did make timely submissions, which as a result of not being addressed to the Registrar as required by the Tribunal’s Rules of Procedure, were not brought to the attention of the Vice-Chair who rendered the above-mentioned Interim Decision.

3Those submissions have now been reviewed and the Tribunal finds that their content does not change the Interim Decision which decided that the respondent’s request for deferral of the Application was dismissed.
