1This is an Application filed on August 8, 2008 under section 34 of Part IV of the Human Rights Code, R.S.O. 1990, c. H.19 as amended (the “Code”). The hearing in this matter is scheduled to begin on September 21, 2009.
2On August 20, 2009, the Tribunal granted the applicant’s request to amend her Application to include the claim that she was dismissed because she filed a human rights complaint. The respondents were given until September 4, 2009 to file amended Responses to address this claim. The Tribunal further directed the parties to provide disclosure of any documents relevant to the allegation that the applicant was dismissed because she filed a human rights complaint, by Friday, September 11, 2009. The respondent Metroland’s request for an adjournment of the hearing, based on the amendment, was refused.
3The respondent Metroland has filed an Amended Response to respond to the allegation about the applicant’s termination from employment. Metroland has also reiterated its request for an adjournment.
4On the Tribunal’s review of the material before it, the adjournment is denied. The hearing will proceed on September 21, 2009. Subject to further direction from the Tribunal, the hearing will begin with the applicant’s evidence on all issues.
