1This is an Application filed on May 26, 2009, under section 34 of Part IV of the Human Rights Code, R.S.O. 1990, c. H.19, as amended (the "Code").
2The Application was sent to the respondents on June 5, who filed a Response on July 10. The applicant filed a Reply to the Response on July 31.
3On August 7, the respondents filed a Request for Order During Proceedings seeking leave to amend their Response to add facts that they state were not in their possession at the time of filing the Response.
4The applicant objects to the proposed amendments. On review of the material before it, the Tribunal grants the Request. In view of the stage at which the Request to amend has been made, the nature of the amendments, and the absence of any apparent prejudice, there is no reason to deny the amendments. The applicant may file a supplementary Reply by September 15, 2009.
5Given the parties' consent, the Tribunal will schedule mediation of this Application.
6I am not seized.
