INTERIM DECISION
Adjudicator: Leslie Reaume Date: February 11, 2009 Citation: 2009 HRTO 135 Indexed as: Williams v. Zellers Inc.
1This Interim Decision addresses a Request to Intervene by the CAW Local 1000, (the "union") the bargaining agent for the applicant.
2The union is seeking to intervene on the basis that it has an interest in the outcome of the Application. The collective agreement administered by the union contains both harassment and discrimination provisions.
3The Request to Intervene was delivered to the applicant as well as the corporate and individually named respondents. None of the parties have responded to the Request. The union did not request to participate in the hearing on any specific terms.
4It is appropriate to grant the union intervention status in the circumstances.
Order
5The CAW Local 1000 is added to this Application as a non-party intervenor on the following terms:
a. The Registrar will provide the intervenor with copies of the materials filed by the parties which are not currently in the intervenor's possession;
b. The parties are instructed to copy the intervenor with any subsequent materials in this matter;
c. The hearing adjudicator will determine the extent and form of the intervenor's participation in the hearing.
6I am not seized of this matter.
Dated at Toronto, this 11th day of February, 2009.
