1This is an Application filed on January 19, 2009 under section 34 of Part IV of the Human Rights Code, R.S.O. 1990, c. H.19 as amended (the "Code").
2The respondents requested that the Application be deferred pending the completion of criminal charges against the individual respondent. The Tribunal invited the parties' submissions on the request, which was opposed by the applicant, and was subsequently advised that these charges have been withdrawn. The respondents state that the issue is therefore moot.
3In the circumstances, there is no reason to defer the Application, and it shall proceed. Given the consent of the parties, the Tribunal will schedule mediation. The requests by the respondents to dismiss the Application on the basis that its substance has been dealt with in proceedings before the Landlord and Tenant Board and the Workplace Safety and Insurance board will be addressed by the Tribunal, if necessary, following mediation.
