1This is an Application filed on May 22, 2009 under section 34 of Part IV of the Human Rights Code, R.S.O. 1990, c. H.19 as amended (the “Code”).
2Instead of filing a Response, the respondents have filed a Request for an Order During Proceedings. They state that there is a criminal investigation ongoing into the allegations of sexual harassment that are the subject of the Application. The respondents ask for a stay of the Application until the completion of the investigation and a decision is made about the laying of charges. The respondents assert that their Charter rights would be seriously threatened and possibly breached should they be compelled to respond to the Application at this time.
3The applicant has not responded to the Request and the time for doing so has lapsed.
4In the circumstances, the Tribunal shall take no further steps in this Application for a period of up to one year unless contacted by one of the parties to advise that the police investigation has been completed. If no party communicates with the Tribunal by August 5, 2010, the Application may be dismissed as withdrawn.
