Reasons for Decision
1This is an Application alleging discrimination in goods, services and facilities on the basis of sexual orientation contrary to the Human Rights Code, R.S.O. 1990, c.H-19, as amended (the “Code”). A hearing was scheduled for July 21, 2009 commencing at 9:30 am at the Tribunal’s hearing centre in Toronto.
2The applicant was not present at the hearing. In accordance with its usual practice, the Tribunal waited until 10:00 am before proceeding.
3The respondent urged me to conduct an abbreviated hearing on the merits, either by treating the Application as evidence or by a respondent witness entering the Application as evidence, following which the respondent would give its evidence. I indicated that I was reluctant to do so given the applicant’s absence and hereby confirm that such a proceeding would be inappropriate in the circumstances.
4I am satisfied that the applicant had notice of the hearing. A Confirmation of Hearing notice was sent to the applicant on April 28, 2009. This document was not returned to the Tribunal.
5In view of the applicant’s non-attendance, the Application is hereby dismissed.
