1In a previous Interim Decision, 2009 HRTO 614, the Tribunal deferred this Application pending the conclusion of a hearing before the Landlord and Tenant Board (“LTB”). That proceeding has now concluded through the withdrawal of the LTB Application. The applicant has now filed a Request to proceed under Rule 14.3. The respondent made no substantive submissions.

2In the circumstances, the request to proceed is appropriate and is granted. The Registrar shall schedule the Application for a hearing.
