1In an Interim Decision, 2009 HRTO 706, the Tribunal sought submissions on the Tribunal’s jurisdiction to deal with the Application.
2The Interim Decision noted that the only ground of discrimination identified in the Application was reprisal but the allegations raised in the Application did not appear to be linked to an attempt to claim or enforce Code-based rights. The applicant was asked to file submissions within two weeks of the Interim Decision and was advised that if no submissions were filed the Application might be dismissed.
3To date, no submissions have been received. Since the only ground identified in the Application is reprisal, and since the Application contains no allegations relating to this ground, the Tribunal does not have jurisdiction to deal with the Application. The Application is dismissed.
