1This Interim Decision addresses the applicant’s request to withdraw his Application, filed under s. 34 of the Human Rights Code, R.S.O. 1990, c. H.19, as amended, against one of the two named respondents, the Sheet Metal Workers’ International Association, Local Union 540 (the “union”).
2In an earlier Interim Decision, 2009 HRTO 781, the Tribunal deferred the Application pending conclusion of a grievance. The Tribunal also indicated that if the corporate respondent opposed the applicant’s request to withdraw the Application against the union, it was to provide submissions to the Tribunal and the other parties by June 15, 2009. If no submissions were received, or if the corporate respondent consented, the Tribunal indicated that the request to withdraw would be allowed. The corporate respondent made no submissions on the request. The Application as against the union is withdrawn with leave of the Tribunal and the style of cause is amended accordingly.
