I am hereby directing as follows:
The Tribunal will not hear the expert evidence of Dr. Frances Henry.
If the Commission or the complainant wishes the Tribunal to consider any relevant materials on race analysis or racism in education other than caselaw or the Commission’s Policy and Guidelines on Racism and Racial Discrimination, these materials are to be provided to the parties and submitted to the Tribunal, with relevant passages marked, prior to the close of the Commission’s and the complainant’s case on Monday, September 26, 2008.
The Tribunal will not hear the evidence of Sue Eaman.
My reasons for these decisions and my decisions on the other matters raised in the Tribunal’s correspondence dated August 5, 2008 will be released to the parties shortly.
