DECISION
1In an Interim Decision in this matter, 2008 HRTO 44, the Tribunal ordered the Ontario Human Rights Commission (“Commission”) to file a revised hearing brief that complies with the Tribunal’s Rules by August 1, 2008. Counsel for the Commission seeks an extension to August 15, 2008, as a result of a busy hearing schedule between now and then, and because complying with the Tribunal’s order will be “extremely laborious and time consuming”. Counsel for the respondent consents, on condition that there is an equivalent extension to the other parties’ deadlines. Counsel for the complainant does not consent to the extension request. She is commencing a new position on September 1, 2008, and will be unable to assist her client in completing the hearing brief requirements if the extension is granted.
2Granting the Commission’s extension request would cause prejudice to the complainant. As the need for revised pleadings resulted from the Commission’s failure to follow the Rules, the complainant’s interests should take priority. The Commission’s extension request is denied.
