DECISION

1The Commission requests a written hearing in this matter. However, the evidence it filed in support of its request indicates that it has not served the corporate respondent, 507638 Ontario Limited with the referral or its request for written hearing at the “Mailing Address” listed on the current Corporation Profile Report of the Ministry of Consumer and Business Services. It sent these documents to the “Registered Office Address”, which is different. The mailing address was not provided to the Tribunal and the Tribunal has accordingly not corresponded with the corporation at this address.

2Accordingly, the Commission is directed to send the referral brief and notice of the request for written hearing to 507638 Ontario Limited, 1019 Nelson Street, Oshawa, Ontario, L1J 4K1. It shall confirm whether such documents were successfully delivered, with confirmation from the courier company, by July 21, 2008.

3Moreover, the Tribunal will send copies of this decision and the Tribunal’s previous correspondence to the corporate respondent at this address. The corporate respondent is directed to advise the Registrar by July 30, 2008 if it intends to participate in this proceeding. If it does not, decisions that affect it, including possible orders that it pay monetary damages to the complainant and for various other remedies may be made without its participation. The Tribunal shall make a decision on the request for written hearing after this date.
