[1] By letter dated December 2, 2008, the Ontario Human Rights Commission (the “Commission”) referred to the Tribunal a further fifty-seven complaints regarding the special diet allowance, set out at Schedule “C”. Over one hundred complaints related to the special diet allowance were previously referred to the Tribunal.
[2] In the referred cases, the Tribunal has adopted a “lead case” approach under which five of the Commission-referred complaints are being heard in advance of the others: see Ball v. Ontario (Community and Social Services), [2008 HRTO 24](https://www.minicounsel.ca/hrto/2008/24) (“Ball #2”); Ball v. Ontario (Community and Social Services), [2008 HRTO 29](https://www.minicounsel.ca/hrto/2008/29); Ball v. Ontario (Community and Social Services), [2008 HRTO 72](https://www.minicounsel.ca/hrto/2008/72); and Ball v. Ontario (Community and Social Services), [2008 HRTO 207](https://www.minicounsel.ca/hrto/2008/207). Hearings in the lead cases are scheduled in March, April and June of 2009. The remaining cases will be heard afterwards, following a procedure to be developed at a case conference after the decision on the lead cases. The Commission is a party on all referred cases.
[3] In various Applications under s. 34 of the amended Human Rights Code, R.S.O. 1990, c. H.19, as amended, the Tribunal has suspended the requirements for further steps until a final decision is issued in the lead cases: Lawson v. Ontario (Community and Social Services), [2008 HRTO 59](https://www.minicounsel.ca/hrto/2008/59); Cloutier v. Ontario (Community and Social Services), [2008 HRTO 78](https://www.minicounsel.ca/hrto/2008/78); Zottarelli v. Ontario (Community and Social Services), [2008 HRTO 186](https://www.minicounsel.ca/hrto/2008/186); and Pilon v. Ontario (Community and Social Services), [2008 HRTO 380](https://www.minicounsel.ca/hrto/2008/380).
[4] Unless there are compelling reasons not to do so, the Tribunal intends to apply the lead case procedure to the new referrals, for the reasons set out in Ball #2 at paras. 6-7:
I find that the joint proposal by counsel represents a procedure that is fair, just and expeditious and I propose to make an order implementing that procedure, with some modifications. I understand the frustration of the complainants who would like this matter determined much faster. However, to determine the merits of the complaints, the Tribunal must decide whether the contested program violates the Code. In doing so, its role is not to decide what in its view is the best policy, but rather to adjudicate whether the legislative regime has the effect of discriminating based upon one of the prohibited grounds in the Code and, if applicable, if a defence under the Code has been established. The Tribunal can only do so after hearing evidence and argument from all sides.
Legal proceedings of this nature, which are complex and involve the review, preparation and presentation of much evidence (including expert medical reports) and detailed legal argument, often take considerable time. In my view, the period proposed here is not unreasonable in light of the issues in these cases and the preparation required. Establishing the applicable legal principles in the lead cases and then applying them in other cases will likely lead to a faster resolution of all of the cases than hearing them all together or one at a time. I am also confident that in making this proposal, counsel for the Commission and the complainants have taken into account the interests of complainants in having the matters resolved as quickly as possible and fully presenting the evidence and arguments on behalf of their clients.
[5] Accordingly, the Tribunal will not hold an Initial Conference Call in the Schedule C referred cases. If any party wishes to make submissions as to the procedure to be applied to the Schedule C referrals, it may serve and file such submissions in writing by January 12, 2009. For complainants, this means that submissions should be copied to the Commission and the respondent and filed with the Tribunal.
[6] If no submissions are received, the following aspects of the Order made in Ball v. Ontario (Community and Social Services), [2008 HRTO 207](https://www.minicounsel.ca/hrto/2008/207), para. [11](https://www.minicounsel.ca/hrto/2008/207) shall also apply to the Schedule C referrals:
The Commission shall continue as a party to all of these complaints throughout the proceedings;
Following the decision on the lead cases, the Tribunal shall schedule a case conference to determine a procedure to address the remaining cases;
This Order does not affect the right of the respondent to request a stay of proceedings as a result of litigation before the Social Benefits Tribunal.
