INTERIM DECISION

1The applicant filed an Application under s. 34 of the Human Rights Code, R.S.O. 1990, c. H.19, as amended, (the "Code"), on September 16, 2008.
2On September 23, 2008, the Tribunal issued a Notice of Application. The respondent was advised that it must file a Response not later than 35 days after September 23, 2008.
3A previous interim decision, Burns v. Toronto Social Housing Connections, 2008 HRTO 316, dealt with the fact that a Response had not been received from the respondent. The respondent was advised that if it wished to participate in the proceeding, it must file a Response by December 2, 2008, together with an explanation of why the Response was not filed in accordance with the September 23, 2008 Notice.
4On December 2, 2008, the respondent filed a Response and an explanation for why the Response was not sent earlier.
5The respondent advises that while the Application was sent to the correct address, the respondent was incorrectly named. The correct name of the respondent is Access Housing Connections Inc. and the style of cause has been amended to reflect the correct name.
6The respondent further advises that it only learned of the Application when the Interim Decision was received on Friday November 28, 2008. The respondent then contacted the Tribunal to obtain a copy of the Application. A full Response was received by the Tribunal on December 2, 2008, in accordance with the Interim Decision.
7I am satisfied that the respondent has complied with the Interim Decision. The Tribunal will accept and process the Response.
