1The applicant filed an Application under section 34 of Part IV of the Human Rights Code, R.S.O. 1990, c. H.19 as amended, (the “Code”) on July 25, 2008.

2The Tribunal issued a Notice of - Application on September 3, 2008 advising the respondents that their Response must be filed with the Tribunal by October 8, 2008. A Response was not filed within the required time.

3In an earlier Interim Decision in this matter (Weber v. Methadrug Clinic, 2008 HRTO 197) the Tribunal directed the respondents to file their Response by November 12, 2008 and provide an explanation why the Response was not filed in accordance with the September 3, 2008 Notice.

4A Response was filed on November 12, 2008 and the respondent’s counsel indicates in his submissions that the failure to respond earlier was the result of a counsel error.

5The Tribunal will accept and process the Response.
