[1] The purpose of this decision is to clarify some matters arising out the Tribunal’s previous Interim Decision [2008 HRTO 307](https://www.minicounsel.ca/hrto/2008/307).
[2] Lana Salenkova, David Tartakovsky and Vella Tartakovsky are named respondents to these proceedings.
[3] A Case Resolution Conference is scheduled for April 2009 and the dates for exchanging and filing material were set as follows:
Applicants: November 26, 2008
Respondents: December 30, 2008
[4] The Tribunal makes the following amended case management order:
The respondents shall, within ten days of the date of this decision, file written submissions in response to the applicant’s assertions that Ms. Tartakovsky was in apparent good health and distributing Halloween candy on October 31, 2008 and why the Tribunal should not amend the date for the Case Resolution Conference. In particular, the respondent is directed to provide the date and duration of Ms. Tartakovsky’s hospitalization (with documentary support if desired).
[5] Upon receipt of the written submissions, the Tribunal will determine whether the Case Resolution Conference should be changed to an earlier date than April 15, 2009.
