Reasons for Decision
1This is an Application filed on October 22, 2008 under section 34 of Part IV of the Human Rights Code, R.S.O. 1990, c. H.19, as amended (the “Code”). The Application, which alleges discrimination in employment on the basis of a record of offences, has not yet been served on the respondents.
2After filing the Application, the applicant delivered a Request for an Order during Proceedings (“Request”) pursuant to Rule 19 of the Tribunal’s Rules of Procedure for Applications under Part IV of the Code to the respondents. In the Request, the applicant seeks to amend the Application to add disability as a ground of discrimination. He also makes additional representations under the heading "Summary".
3It is not clear whether the applicant seeks to amend the Application to incorporate his additional representations or whether he makes these representations only in support of the Request. In the circumstances, the Tribunal requires that the applicant advise the Tribunal and the Respondents in writing of the intended purpose of the additional representations by December 3, 2008.
4The Registrar is directed to serve the Application upon the respondents with this decision. The respondents are not required to respond to the Application until the Tribunal determines the applicant’s Request.
5With regard to the Request, the respondents may complete the Response to Request for Order, deliver it to the Respondents and file it with the Tribunal not later than December 17, 2008. Failure to respond to the Request by December 17, 2008 will be understood as consent to the Request.
