1This is an application filed September 16, 2008 under section 34 of Part IV of the Human Rights Code, R.S.O. 1990, c. H.19, as amended (the "Code"). This interim decision addresses the issue of contact information of a union.
2The applicant states that she has been employed by the corporate respondent for nineteen years. She alleges that in January 2008, the company did not call her back to work because of her age. Included with the Responses is a collective agreement between the corporate respondent and Glendale Lodge - Local 2374 International Association of Machinists and Aerospace Workers (the "Union") which describes the bargaining unit as including all employees save and except supervisors, persons above the rank of supervisor, and office and sales staff.
3Neither the applicant nor the respondents have named the Union as an affected party. It is not clear whether the Application raises issues that may have an impact on the rights of the Union. However, without determining whether this is the case, the Tribunal will give notice to the Union and an opportunity to seek leave to intervene.
4None of the material filed discloses an address for the Union. Under Rule 1.7(p) of the Tribunal's Rules of Procedure, the Tribunal may require a party to produce information in order to provide for the fair, just and expeditious resolution of a matter before it. In order to enable the Application to be sent to the Union, I order the respondent Glendale RV a Division of Glendale International Corp. to provide the Tribunal with contact information for the Union. This information must be provided to the Tribunal by December 2, 2008.
