1The applicant filed an Application under s. 34 of the Human Rights Code, R.S.O. 1990, c. H.19, as amended, (the “Code”) on August 6, 2008. The applicant alleges that the respondent employer discriminated against her on the basis of her disability.
2The Tribunal, in an interim decision dated October 9, 2008, 2008 HRTO 142, asked the applicant for submissions on the respondent’s request that the Application be deferred pending the outcome of the applicant’s current grievance. The applicant was directed to deliver her submissions no later than 14 days from the date of the Tribunal’s decision. The respondent was directed to provide reply submissions, if any, within 7 days of receipt of the applicant’s submissions. The Tribunal has received no submissions from the parties as of the date of this decision.
3On my review of the file, I am not satisfied that the applicant was sent a copy of the interim decision in sufficient time to consider whether to make submissions on the issues raised before the deadlines set by the Tribunal.
4I therefore order that copy of this interim decision along with an attached copy of the Tribunal’s October 9, 2008 decision be sent to the applicant’s designated contact person as well as to Ms. Mitchell and to the respondent. Rather than the deadlines provided in the October 9 decision, the applicant is to provide her submissions, if any, no later than 14 days from the date of this decision. The respondent may provide any response within 7 days of the receipt of the applicant’s submissions.
