1This is an Application filed September 18, 2008 under section 53(3) of Part VI of the Human Rights Code, R.S.O. 1990, c. H.19, as amended (the “Code”).
2In a prior Interim Decision the Tribunal ordered the respondent to file its Response (Form B) and requested submissions from the parties (and the Ontario Human Rights Commission, if it desired) on whether this is a continued complaint within the meaning of the section 53(3)of the Code.
3The respondent has requested an extension of time for filing its Response until after the preliminary issue identified in paragraph 2 above is dealt with.
4The respondent is not required to complete section 2 of the Response at this time; however, the respondent is required to complete and file sections 1 and 3 of the Response (identification of the parties and their representatives) by November 26, 2008.
5The respondent’s request for an order for production of the applicant’s medical history is premature.
6A copy of this decision shall be sent to the Commission.
