Reasons for Decision
1The purpose of this decision is to clarify Interim Decision 2008 HRTO 153.
2The applicant has sought clarification whether the applicant’s preliminary objections with respect to counsel would be dealt with prior to the respondents’ preliminary requests to dismiss.
3The Tribunal clarifies that the first issue to be heard and determined at the case resolution conference on February 9, 2009 will be the applicant’s objection to the participation of respondents’ counsel. The decision whether to go on to hear the respondents’ preliminary requests on that day rests with the adjudicator assigned to hear the matter and will depend on the outcome of the applicant’s request.
4The parties should be prepared to make oral submissions on all matters set out in Interim Decision 2008 HRTO 153, if required.
