Reasons for Decision
1The applicant has brought a Request for Order During Proceedings under Rule 19 of the Tribunal’s Rules of Procedure, which he asks be heard ex parte (without notice to the respondents or affected parties). The request seeks extensive relief that affects the respondent Windsor Regional Hospital, as well as the Public Guardian and Trustee and the Consent and Capacity Board, who are not parties to the Application. It is identical to a request which was served upon the other parties. The deadline for submissions on the other request has not yet passed.
2There is no need to decide whether the Tribunal has jurisdiction to proceed ex parte. The applicant has provided no reasons why this request should proceed without notice to other parties, and it would not be appropriate in the circumstances. It would be unfair to determine these issues before the other parties to the request have had the chance to make submissions. The request is denied.
3I am not seized of this matter.
