1This is an application dated September 3, 2008 under section 53(3) of Part VI of the Human Rights Code, R.S.O. 1990, c. H.19, as amended (the “Code”).
2The Tribunal has scheduled a mediation for November 3, 2008, advising the parties that the date would only be changed for important reasons.
3By letter dated September 18, 2008 the respondents requested an adjournment of the mediation. On September 22, 2008 the Tribunal requested the respondents provide further explanation in support of the request by September 24, 2008.
4On September 29, 2008 the Tribunal received a Response to the Application under cover of a letter dated September 25, 2008. That letter indicated the respondents’ agreement to mediation. Thus, it appears the respondents have abandoned their request for an adjournment of the mediation and in any event have not advanced reasons to support it. Accordingly, the mediation on November 3, 2008 will proceed as scheduled.
5The September 25, 2008 letter raises a number of other issues including the personal respondent’s request to be removed as a respondent. I am satisfied this and the other issues can be canvassed at the mediation.
6The respondents have indicated that they have had considerable difficulty in delivering documents on the applicant. Courier tracking sheets and facsimile confirmation sheets were filed in support. The respondents attempted to deliver their Response (Form B) on the applicant by courier on September 26, 2008. According to the material provided the package had not been retrieved as of October 2, 2008.
7If the applicant’s contact information is no longer valid he should advise the Tribunal and the respondents immediately. The parties are advised the Tribunal has the jurisdiction to deem delivery effected where it is satisfied service is being avoided.
8I am not seized of this matter.
