Reasons for Decision
1This is an application filed July 4, 2008 under section 34 of Part IV of the Human Rights Code, R.S.O. 1990, c. H.19 as amended (the "Code"). The applicant alleges discrimination by the respondents on the basis of creed in the area of goods, services and facilities.
2The respondents have, through a Request for Order, asked the Tribunal to dismiss the Application because of delay.
3The applicant has also made a Request for Order asking to amend his Application (consented to by the respondents), and asking that the Tribunal direct the respondents to provide certain particulars and specified documents (contested by the respondents).
4Mr. MacLennan indicated in his Application that he is willing to engage in mediation, and counsel for the respondents has advised in her response that her clients are willing to enter into mediation. In light of the above, the Tribunal will schedule a mediation date.
5In these circumstances, with the exception of the request to amend, it is not necessary to decide the Requests for Orders prior to the mediation. Having regard to the consent of the parties and the material before it, the Tribunal allows the amendments to the Application requested by the applicant.
6The Registrar is directed to schedule a mediation date. I am not seized of this matter.
