1A previous interim decision in this matter, Cook v. Kwik Copy Design and Print Centre, 2008 HRTO 86, dealt with the respondent’s failure to respond by the deadline set in accordance with the Tribunal’s Rules. The response has now been filed. Based on the respondent’s submissions, the Tribunal is satisfied that there was a delivery error and that the response was sent to the Tribunal prior to the deadline. The Tribunal will, therefore, accept and process the response.
