Reasons for Decision
1A previous interim decision in this matter, Aubin v. Waterloo (Regional Municipality), 2008 HRTO 86, dealt with the respondent’s failure to respond by the deadline set in accordance with the Tribunal’s Rules. The response was filed on September 23, 2008 and the respondent’s counsel indicates in his submissions that the failure to respond was the result of an error. The Tribunal will, therefore, accept and process the response.
2The response requests that the Tribunal defer the application, stating that the facts of the application are the subject of two union grievances that have been referred to arbitration. The applicant is directed to respond to the respondent’s deferral request in her reply, as the Tribunal may decide the deferral issue after it receives the reply.
