1Following on our Interim Decision of October 3, 1996 (# 96-034-1) [CHRR Doc. 96-273] the panel has reviewed written submissions contained in the following documents:

(a) written submissions dated October 9, 1996 (2 pages) from Mr. Robert Wong;

(b) written submissions dated October 15, 1996 (12 pages) and the appended exhibit "A" (2 pages) from Ms. Lisa Cirillo, Student-at-Law, for the Ontario Human Rights Commission;

(c) written submissions dated October 22, 1996 (5 pages) from Mr. Ted Kovacs, Counsel for the Respondents; and

(d) written reply submissions dated October 28, 1996 (6 pages) from Ms. Lisa Cirillo, Student-at-Law, for the Ontario Human Rights Commission.

DECISION:

2The panel determines the following as the only viable options:

(1) the resumption of the hearing on a date earlier than April 2, 1997, to continue with the cross-examination of Mr. Robert Wong, AND any re-examination, if any, of him AND to continue immediately with the remainder of the hearing; or

(2) not to resume the cross-examination of Mr. Robert Wong until April 2, 1997 (i. e. maintain the status quo).

3IF ALL PARTIES choose option (1), they are REQUIRED to notify the Deputy Registrar immediately and be available for a Teleconference call at 9:00 a.m. on Wednesday, November 27, 1996.
