The applicants sought judicial review of a decision issuing departure orders against them after their refugee claims were denied. They filed their application for leave and judicial review nearly 9 months late and requested an extension of time. The Federal Court denied the extension, finding no reasonable explanation for the delay and prejudice to the respondent. The Court noted that relying on legal counsel and ignorance of the law are not valid excuses. The application for judicial review was dismissed as moot. The Court also held that even if considered on the merits, the departure orders were not unreasonable as they flow automatically from a failed refugee claim.
