Christopher Anzalone

The applicant, a citizen of Somalia who had lived in Canada since childhood, sought judicial review of a Minister's Delegate's decision finding him a danger to the public and ordering his removal.

The applicant challenged the risk assessment, arguing the Delegate failed to consider an expert report regarding risks in Somalia and unreasonably assessed humanitarian and compassionate factors.

The Federal Court allowed the application, finding the Delegate erred by failing to address contradictory evidence in the expert report and by conducting a superficial analysis of the applicant's reintegration difficulties given his lack of language skills and support in Somalia.

The decision was set aside and returned for redetermination.
