The City of Toronto appealed a Committee of Adjustment decision granting variances for a proposed three-storey detached dwelling.
Prior to the hearing, the applicant revised the proposal to a duplex, eliminating the need for three of the four variances, including floor space index.
The only remaining variance was for a reduction in the required front yard soft landscaping.
The City withdrew its objections subject to a condition requiring permeable paving.
The tribunal found that the amended application did not require further notice and that the soft landscaping variance met the four tests under s. 45(1) of the Planning Act.
The appeal was allowed in part to authorize the single variance subject to conditions.
